Amendments to Terms and Conditions
The Techanic reserves the right to change any and all Terms and Conditions without prior written notice at The Techanic's sole discretion, by posting a copy of the amended Conditions at the Online Store. Any attempt to modify, supplement or amend the Terms and Conditions as stated on the Online Store by any party other than The Techanic will be null and void, unless expressly agreed to in writing by The Techanic.Product Descriptions
The Techanic has made every effort to display and describe as accurately as possible the colours, sizes, dimensions, information and other attributes of Products (henceforth referred to as "Attributes”). However, due to the inherent limitations of electronic displays and the characteristics of certain materials, actual Attributes of individual Products may vary. Slight marks and colour/print variations will not be considered as defects as they do not render the Product non-compliant, but are inherent characteristics of the Product.Orders, Price and Payment
The Techanic currently only processes Orders for delivery in Singapore.
Customers shall indicate the type and quantity of Products they wish to order by placing an Order on the designated online form at the Online Store. Customers must provide all information as required by The Techanic (stated in the online form at the Online Store), otherwise the Order will not be processed.
All Orders will be subjected to acceptance by The Techanic. The Techanic may accept an Order by contacting the Customer by telephone, email or other mode(s) of communication within a reasonable time after the Customer has made the Order, to accept and confirm the price, quantity, and delivery date and time of the Product(s) ordered by the Customer.
The price to be paid by the Customer for all Products shall be The Techanic's current selling price on the date of receipt of the Order by The Techanic, which may or may not be correctly reflected at the Online Store.
Any applicable promotional offers, vouchers, or online store credit must be stated before checkout. No promotional offers, vouchers, or online store credits may be applied retroactively to any standing or previously placed Order.
The Customer shall agree to submit to The Techanic and/or The Techanic's Payment Service Providers any necessary online payment or credit card information, as well as other personal information, as may be reasonably requested by The Techanic and/or The Techanic's Payment Service Providers, to process the payment for the Order, and to arrange for delivery and invoicing. The Techanic shall require its Payment Service Provider to keep such information confidential and not use the information for any purpose other than to carry out its services, on the condition that the Customer agrees that The Techanic shall not be responsible for any loss, damage, or liability in the event of any unauthorised disclosure of such information by its Payment Service Provider.
The Techanic reserves the right from time to time, without liability or prior notice, to withdraw or cease to make available any or all Products from the Online Store.
The Techanic reserves the right to exercise its lawful remedies if a dispute or issue arises over Online Payments, or if it does not receive full payment for an Order. In particular, but without limitation to any other remedies, if the Payment Processing Company or the paying bank rejects or reverses payment for an Order, The Techanic may in its discretion:
- Reject such an Order, or suspend/cancel delivery of such an Order;
- Repossess the Products if delivered; or
- Claim against the Customer for the full price of the Order as a debt.
- The Techanic shall be entitled to off-set and deduct from any refund due to the Buyer all sums owed by the Buyer to The TEchanic under any and all Contracts and other agreements.
The Customer shall designate in the Order the Customer’s preferred delivery option or if available, collection options. Where the delivery option is selected, the address for delivery of the Products is needed.
Order Delivery and Cancellation is always subject to The Techanic's acceptance of the Order.
Where the delivery option is selected, The Techanic shall deliver the Products to the place of delivery as designated by the Customer and agreed to by The Techanic. If no one is available at the delivery address to receive the Products, The Techanic’s delivery agent will leave an "unable to deliver" card at the address and the Customer should follow the directions on that card to obtain the undelivered Products.
The Techanic is unable to ship to any PO Box, military, protected area or location. Shipping and other charges for failure of attempted delivery to the restricted areas will be borne by Customer or recipient of the Products.
Customers are to be aware that the courier company or customs authority in their sole discretion, may open and inspect for any reason the contents of the Product package. In the event that such inspection occurs, The Techanic shall not be liable for any loss or damage thereby caused.
Any shipment, delivery or collection dates provided by The Techanic are only estimates and shall not form part of the Contract. The Techanic shall not be liable for any loss, damage or cost resulting from failure to meet any given estimated shipment, delivery or collection date, howsoever caused. If the Customer's Order has not been delivered within a reasonable time, the Customer should contact The Techanic via mail.
An Order may be cancelled by the Customer prior to shipping, provided always that the Customer contacts The Techanic to request The Techanic for cancellation immediately. If Shipping Confimartion has not yet been emailed/processed, The Techanic will endeavour to accommodate the Customer's request. In the event that Shipping Confirmation has already been emailed/processed, no cancellation or refund of the Order by the Customer will be permitted.
The Techanic reserves the right to make only partial delivery of an Order. If only part of the Order can be shipped, The Techanic will use reasonable efforts to contact the Customer to select replacements. If the Customer cannot be contacted, The Techanic will reject the entire Order.
The Techanic shall not be liable for any lost of postage should the customer not select the registered postage option.Acceptance of Product
Unless the Customer notifies The Techanic in writing to the contrary within five (5) days of the date of delivery, the Products shall be deemed to have been accepted by the Buyer as being in good condition and in accordance with the Contract.
A Product shall only be eligible for replacement if upon delivery: (i) it is damaged; or the Product supplied is materially different from the Product specified in the Order, (ii) The Customer must report any Defective Product to The Techanic by submitting a “return request” through email, describing the reasons and the Defective Product to be returned: within five (5) days of its delivery, failing which the Customer shall not be entitled to a replacement Product.
If The Techanic considers the Product to be a Defective Product, the procedure for returns set out in The Techanic's Returns Policy will apply. The Customer must produce the receipt together with the Defective Product in its original delivered condition and packaging.
The Techanic reserves the right to refuse any return or replacement of a Defective Product if: (i) The Buyer is unable to produce the Product details or tax receipt; (ii) The defect is the result of:
- unique, accidental, or random damage that is the result of use by Customer, or wear and tear;
- accidental nicks, scratches, or minor damage;
- improper use or mismanagement by Customer;
- use of the Product in a manner or for a purpose not reasonably contemplated by The Techanic;
- modification of the Product not authorised by The Techanic;
- unusual or non-recommended physical, environmental or electrical stress by Customer;
- use of Product by a person other than Customer; or
- The Customer’s failure to comply with any terms of these Conditions.
Shipping and Restrictions
Certain countries impose customs, import, export and/or other regulatory requirements and restrictions on Products. The Customer shall be responsible for ensuring that all Products in the Order are and will be compliant with such requirements at their own costs. The Techanic shall not be liable for any non-delivery or delay in delivery of any Product which fails to meet such requirements or which is intercepted by any government or regulatory authorities.
In no event shall The Techanic be liable to the Customer or any third party for any indirect, special, consequential, exemplary or punitive loss or damage for any breach of these Conditions, including but not limited to loss of profits, loss of business or goodwill, loss of use, or any claim by any third party, even if The Techanic has been advised of the possibility of such loss or damage.
If any service (including but not limited to installation of any Product) is performed by any third party, The Techanic shall not be liable for any act, neglect, omission or wilful default of such third party, regardless of whether such third party is authorised by The Techanic.
The total liability of The Techanic to the Customer for any and all claims whether by the Customer or by any other person and howsoever arising in connection with or arising out of the sale, supply, delivery possession, replacement or use of a Product or resulting from the breach of the Contract and/or these Conditions by The Techanic shall not in any event exceed the price of the product giving rise to such claims.Summary
The Contract and these Conditions represent the entire understanding between The Techanic and the Customer concerning the sale and supply of the Products, and shall form the exclusive statement of all the matters covered by the Contract and these Conditions. Any and all previous course of dealings, written or oral understandings, discussions, representations, correspondence and communications between the Parties relating to the matters covered by the Contract and/or these Conditions are hereby superseded. Any term or condition of the Customer’s Order which is any way inconsistent with or in addition to these Conditions shall not be applicable or binding on The Techanic, unless otherwise agreed in a written agreement signed by the Customer and The Techanic, and any failure by The Techanic to object shall not be considered a waiver of these Conditions.
